Setting up a business in the Netherlands

TOSS became a legal registered employer, PEO(Professional Employer Organization)—which makes it possible for your employees to work in the Netherlands. You will still have the supervision and management of your employees while on the other hand, TOSS takes care of the payroll, labor laws, risks, and handles possible immigration matters.

Is Employer of Record service right for you?

TOSS-EOR service is suitable if you:

  • Are unsure whether you have been active on the Dutch market for five years or more
  • Want to have around 1 to 20 employees to work in the Netherlands

  • Are you negotiating a takeover and are looking for a solution in the meantime?

What are the costs?

Every month you will receive an invoice from TOSS. The invoice includes the agreed salary, the employer’s contributions to be paid (such as employer’s premiums/social premiums), taxes and pension contributions. We also charge a monthly TOSS management fee.

After the payment of the monthly invoice, TOSS handles various payments, such as payroll taxes and pension payments and then, the net wages are paid to the employees.

Duration of the contracts

The duration of the contract that we offer to your employee depends entirely on your decision. TOSS is happy to advise you on this. We consult you so that TOSS can make a proposal that best suits you and your employees.

Here are the several options:

  • Flexible contract, monthly contract for a total of 7 contracts in 4.5 years
  • Fixed-term contract, you can offer a temporary contract 3 times for a maximum of 3 years
  • Permanent contract for an indefinite period

In all cases, there is a notice period. With the fixed-term contract, there is a notice period of at least 1 month and with the permanent contract, it depends on the agreement. In most cases, it is 2 months or even more.

The working conditions

The employees on our payroll receive their wage calculation based on the Dutch legislation and regulations.

It is possible to offer this set-up to your Dutch employees within the organization. For example, the continued payment of wages in the event of illness or providing additional vacation days. Everything is possible. We are more than happy to offer you our customized service tailored to your business needs.

Knowledge migrant and or expats

If you hire someone, for example a highly skilled migrant outside the EU, the employee may need a ‘recognized sponsor’. TOSS is a recognized sponsor and reliable partner for the IND (Immigration and Naturalization Service or Immigratie- en Naturalisatiedienst in Dutch). We can apply for the work and residence permit within 24 hours of communicating with you. If necessary, we can also include the MVV (authorization for temporary residence or machtiging tot voorlopig verblijf in Dutch) to enable entry to the Netherlands.

You may be able to make use of the 30% facility, which provides a tax advantage for your employee.
